These Terms of Service (“Terms”) govern the website design and development services provided by Fresh Media Nigeria. By engaging with our website design and development services, you agree to comply with these Terms. If you do not agree with these Terms, please do not use our services.
Service Description:
Fresh Media Nigeria offers website design and development services tailored to your specific needs. Our services may include creating custom designs, coding, content integration, and testing.
Client Responsibilities:
You are responsible for providing accurate and complete information required for the project, including branding materials, content, and design preferences. If you request Fresh Media Nigeria to create required content, additional charges may apply.
Project Timeline:
We will provide an estimated project timeline based on the scope of work. Delays caused by factors beyond our control (such as third-party services, client feedback delays, or technical issues) may affect the timeline.
Design Revisions:
We offer a specified number of design revisions as outlined in our project proposal, limited to 2 revisions per project. Additional revisions beyond this scope may incur extra charges.
Content and Materials:
You are responsible for providing all necessary content, images, and materials required for the website. If you request Fresh Media Nigeria to create content, design elements, or other materials, additional charges may apply. You retain ownership of your content, and you grant us the right to use it for the purpose of the project.
Intellectual Property:
Upon project completion and full payment, you will own the intellectual property rights to the custom design elements created for your website. We retain the right to reuse non-custom elements for other projects.
Payment:
Full payment is required before the project begins. Payment terms and schedule will be outlined in our project proposal.
Termination and Refund:
Should termination be necessary, the following refund policy will be followed based on the progress of the website management service:
- If you are dissatisfied after the first revision, a 50% refund of the service fee will be provided.
- Hosting and domain details acquired by Fresh Media Nigeria for the customer will be provided upon request.
- After the second revision, no refunds will be issued.
Warranty and Support:
We provide a warranty period for addressing any bugs or issues related to the website’s functionality post-launch. This warranty does not cover additional features or modifications.
Third-Party Services:
We may integrate third-party services, plugins, or tools to enhance your website’s functionality. You agree to the terms and conditions of these third-party providers.
Limitation of Liability:
Fresh Media Nigeria shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use our website design and development services.
Governing Law:
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.
